Terms of Service & End User Agreement

1. Acceptance of Terms
By accessing, registering, or using the CLUB YOU platform, mobile application, or related services (collectively the “Platform”), you agree to these Terms of Service (“Terms”), our Privacy Policy, and any other policies incorporated herein. If you do not agree, you may not use the Platform.
2. Eligibility
You must:
Be at least 18 years old (or the age of majority in your jurisdiction).
Have the legal capacity to enter into binding contracts.
Use the Platform in compliance with all applicable laws, rules, and regulations.
3. Platform Overview
CLUB YOU is a booking and event services platform that connects:
Hosts & Venue Partners (those booking packages, events, or parties),
Guests (attendees), and
CLUB YOU PROs (service providers, including DJs, bartenders, bottle service staff, chefs, security, decorators, etc.).
GeNi LLC. acts as a facilitator of services but is not a direct party to agreements between Hosts, Venue Partners, Guests, and CLUB YOU PROs.
4. User Accounts
All users must register for an account.
Information provided must be accurate and up-to-date.
Users are responsible for safeguarding login credentials.
CLUB YOU reserves the right to suspend or terminate accounts that violate these Terms.
5. Payments & Payouts
Payments for packages, tickets, and services are processed securely through Stripe.
Hosts and Venue Partners may set ticket prices and event details.
CLUB YOU PROs may receive payouts through Stripe’s supported payout methods.
CLUB YOU does not control delays, fees, or restrictions imposed by Stripe.
By using the Platform, you agree to Stripe’s Terms of Service.
6. Cancellations & Refunds
Cancellation and refund policies are set by Hosts and Venue Partners.
CLUB YOU is not liable for disputes regarding refunds but may assist in resolution at its discretion.
7. User Conduct
Users agree NOT to:
Engage in illegal, fraudulent, or abusive activities.
Harass or harm other users, staff, or service providers.
Misuse the Platform to distribute harmful software or spam.
Attempt to bypass fees, payments, or security features.
Violation may result in immediate account suspension or termination.
8. Liability Disclaimer
CLUB YOU (GeNi LLC.) provides the Platform “as is” and makes no guarantees of uninterrupted service.
CLUB YOU is not responsible for the actions, performance, or conduct of Hosts, Venue Partners, Guests, or CLUB YOU PROs.
To the fullest extent permitted by law, CLUB YOU is not liable for indirect, incidental, or consequential damages arising from Platform use.
9. Privacy & Data
Use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using CLUB YOU, you consent to our data practices.
10. Intellectual Property
All logos, trademarks, software, and content on the Platform are the property of CLUB YOU (GeNi LLC.) or its licensors. Users may not copy, distribute, or exploit any part of the Platform without prior written consent.
11. Termination
CLUB YOU reserves the right to suspend, restrict, or terminate any account that:
Violates these Terms,
Engages in fraudulent activity, or
Threatens the safety or integrity of the Platform.
Users may delete their account at any time through account settings.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to conflict of law provisions.
13. Dispute Resolution
In the event of a dispute:
Parties agree to first attempt informal resolution by contacting CLUB YOU support.
If unresolved, disputes will be submitted to binding arbitration in Hudson County, New Jersey.
Users waive the right to participate in class actions against CLUB YOU.
14. Changes to Terms
CLUB YOU may update these Terms at any time. Users will be notified of material changes via email, push notification, or app update. Continued use of the Platform after updates constitutes acceptance of the new Terms.

CLUB YOU Refund & Reschedule Policy

At CLUB YOU, we are committed to providing high-quality event services and ensuring that every booking is prepared and staffed appropriately. In order to maintain fairness to our staff, vendors, and service providers, the following refund and reschedule policy applies to all bookings:
Refund Policy
Refunds are available within 24 hours of booking.
After 24 hours of completing your booking, all sales are final.
No refunds will be issued beyond the 24-hour period due to immediate allocation of staff, resources, and preparation costs incurred by CLUB YOU.
Reschedule Policy
If you are unable to host your event on the originally scheduled date, CLUB YOU allows you to postpone and reschedule your booking for a later date.
Rescheduling is subject to availability and must be coordinated with our support team.
All rescheduled events must be booked within 12 months of the original event date.
Exceptions
In cases of emergencies or force majeure (e.g., natural disasters, government restrictions), CLUB YOU will work with you to find a fair and reasonable solution.
By completing a booking with CLUB YOU, you acknowledge and agree to this Refund & Reschedule Policy.
